Changes to the Pressure Equipment Directive 97/23/EC

 

The Study

Risk & Policy Analysts Ltd. (RPA) has been commissioned by the European Commission, DG Enterprise and Industry (DG ENTR), to consider the potential impacts of aligning the Pressure Equipment Directive 97/23/EC (PED) with Regulation (EC) No 1272/2008 on classification, labelling and packaging of substances and mixtures (CLP). This alignment of the PED may change the fluid Group of some fluids. If a fluid moves from Group 2 to Group 1 the conformity assessment will change for the pressure equipment containing that fluid and this may result in some pressure equipment no longer meeting the classification category for that pressure equipment. It is also possible for fluids to move from Group 1 to Group 2.   Some further background is presented in this Briefing Note for the study.

The results of the study will inform an Impact Assessment to be prepared by the European Commission which will accompany proposals for changes to the PED which are expected in 2013.  As such, RPA is expected to undertake analysis of the:

  • current situation with regard to classification of substances under the PED; and
  • impacts resulting from alignment of the PED to the CLP Regulation.

The study will be carried out in a transparent way taking into consideration information provided by identified stakeholders from industry and their associations, Member State authorities and Notified Bodies. External input from these groups is essential to the success of this study - please also read a letter from the Commission.
